• Reservation and deposit contract. Once the property to be purchased has been decided, a reservation deposit is established, the amount of which will depend on the final purchase price. It is deposited in the presence of a Notary.
• Contract of sale. It is the same or similar to the earnest money contract, the difference may be in the type of penalty in the event of the renunciation of not selling or not buying the property, but in both cases it will depend on the agreement between both parties.
• Public deed.
  • What is it and what is it for? It is the last step necessary to formalise the sale of the property. It is a deed signed before a Notary. The Notary is obliged to read and explain the entire document and all its clauses.
  • What does the buyer obtain at that moment? Once the buyer has signed the public deed before the Notary and handed over the rest of the money of the sale price, he/she acquires the ownership of the property.
• Tax clearance.
  • Both buyer and seller will have 30 working days to pay the taxes due as explained above.
• Registration in the Land Register.
  • Who and why? It will be the Notary, via telematic means, who will send an authorised copy of the public deed of sale to the Land Registry for its presentation.
• Communication to the Cadastre. The buyer is obliged to notify the Cadastre of the change of ownership of the property within a maximum period of two months from the moment of signing. The corresponding form must be filled in with the details of the new owner, the previous owner, the property and the deed of sale.
